FIGHT DETAIL
So my dad gave me a car. I needed help to get it fixed and someone to share cost of the car to make it easier to afford. my sister agreed with me to share these costs and we would also share the car. I get the car every other weekend she gets it the opposite weekend. So this was working out very good for a few months. Then she wanted to give my car to my brother on her weekends she was not using the car. Now my thought it if she is not using it then i should get it right? But she seems to thing she can give it to anyone. What if this person gets into a crash. I need your help please let me know if i can right here or wrong?

if she is still paying for the car costs then she should be able to let your brother use it once in a while, if he starts to use it all the time then he should be paying the costs that she does.

Whose name is the car in?

Explain My Vote
That was one detail not stated.

Suppose your brother decides that he, in turn can lend the car to yet another party - and they either wreck it, or engage in behavior that gets it seized?

The agreement was for you and your sister to alternate. It didn't provide for a third party. If she is loaning it out to someone else, she is in violation of the agreement. This is like a partnership, where one party can get the other into financial (and even legal) difficulty without their knowledge of consent.

Either re-state the agreement in writing this time, or dissolve the agreement and one buys out the other, or sell it and split the proceeds.

If theres one thing I do know....it's everything!
This is a no win situation. Actually since it's her weekend
she could lock it up and let it sit.
Trust she'll do the right thing(she is your sister after all)
give her the keys man...just give her the keys!!!

buy her out

The biggest issue is the liability. You two can drive the car, but no one else should. It would make for a legal nightmare if someone else, who is not a legal owner, gets in an accident. You could be held responsible too even if it was your sister's "weekend". If she doesn't need the car anymore, buy her out, end the headache and preserve your relationship with your sister.

She's paying half so she deserves to be able to do whatever she wants with the car on her weekends. Why would you be entitled to use the car on her weekends?

Can't We All Just Get Along?

Explain My Vote
Do you really want to spend your life micro managing your sister? Trust me, that will be completely exhausting and will have little effect. Your sister's weekends are her weekends and you are not going to be there to see who is driving and who is not. Make sure she knows that her weekends are her responsibilty and even sign something legal to the effect that she is financially responsible to fix the car if you are worried about it, but then trust her and that she will make wise decisions because it is her transprotation too. Remember though: accidents do happen and they could happen to you too. Buckle up.
